The ipoddoctor site is provided to you free of charge for your personal use subject to the terms and conditions below. By using the ipoddoctor site you are agreeing to be bound by these terms and conditions.

All contracts of sale made by ipoddoctor (hereinafter called "the Company") are subject to these conditions to the exclusion of any and all printed terms and conditions of the Buyer which shall not form part of the agreement. These conditions cannot be varied, suspended or added to except with the prior consent in writing of the Company.

TITLE
The Company retains ownership of all goods supplied until either all monies due and owing by the buyer to the Company are paid. In the event that monies due the Company are unpaid the Company shall have the right (without prejudice to its other rights) to enter the buyers premises and take possession of and remove such goods as have been supplied by the Company as shall be found on those premises or otherwise in the buyers possession.

Shipping and Delivery
We use Royal Mail for all our deliveries.

Recorded Delivery - £2.99.
This will be dispatched same working day up to 14:00 or next working day after receipt of order. Delivery can take 2-3 days to arrive. Royal Mail requires 14 days from date of dispatch before the package is considered late. The goods will need to be signed for on delivery.

Special Delivery - £5.99.
This will dispatched same Working day of order up to 14:00. Delivery Guaranteed (by Royal Mail) before 13:00 next day (Some areas deliver on Saturdays). Goods are insured against loss and damage in transit up to £500.00 (This is the service we use to send goods back after fitting service).
Required for all testing/repair orders

PAYMENT
E-commerce Orders shall be paid for in advance by credit card via the secure facilities provided on the E-commerce site, orders will only be dispatched when payment confirmed by the Internet merchant company. Account customers will be granted 30 days credit from the date of invoice. The company reserves the right to charge interest on all overdue accounts at 4% above the HSBC Bank plc base rate or statutory interest rate, whichever is the greater.

Returns

No goods are to be returned without a valid Returns Number, see RMA Process

We will only issue a Returns Number for the following reasons.

1 .We offer a full refund for items purchased, excluding delivery and installation. If the unit is unwanted it must be returned complete with packaging and accessories unused, we aim to issue refunds within thirty days of receipt.
You must contact us within 14 days of receipt of goods if they are unwanted, after this period you may only return for the following reasons.

2. Should the item arrive faulty or damaged in transit; we will exchange it for a replacement unit or issue you with a full refund.

3. Should the unit develop a fault please contact us. All items are guaranteed for 12 months. This guarantee is in addition to your statutory rights

RMA Procedure
1.After receiving the products from us, please keep the package and enclosed documents inside it. As they will be required if you have to return the products received from us should you receive defective product(s).

2. Email our customer service department for a RMA number. It will be appreciated if you can provide your name, email address, phone and invoice. We will issue a RMA number to you by email.

3.Repack in original package with everything received, including enclosed documents. Missing any part of original component may incur refusal from us.

4.Please write the RMA number clearly on the outside of package and send it back to us. Please note you should be responsible for the loss shipment. We recommend you insure the package to reduce potential loss you may suffer.

THE ORDER
The acceptance of the order may be revoked (in whole or part) or delivery dates postponed by the Company without liability in the event of any contingency beyond Company's control which does or in the Company's opinion is likely to prevent, hinder, delay, interrupt or interfere with the fulfillment of the order or any part thereof. The title of the goods shall remain in the Company and shall not pass to the buyer until the Company has received not only the price of the goods the subject of the immediate contract but all other sums due to the Company on all other contracts. If at any time the Buyer is in default of payment for goods supplied, the Company shall be at liberty to retake possession of all goods supplied and unpaid, and the buyer hereby consents to the entry of the Company or its duly authorized agent, to their premises for the purpose of such recovery of possessions. The Company shall have lien over all goods of the buyer in the possession of the Company for any sum due to the Company from the buyer under the Agreement or any other contract.

GUARANTEE
The Company's liability in respect of any defect in any part of the goods supplied or proved to be defective is limited to making good by replacing or repair at our option or the manufactures option and provided always that such defective parts are returned to the Company carriage paid. The Company warrants that it will be so far as it is able to do so give the buyer the benefit of any express guarantee or warranty by the manufacturer or supplier of such goods and any other rights to which the Company has against the manufacturer. The Company shall not in any circumstances be liable for any damages, compensation, costs, expenses, losses or other liabilities, whether direct or consequential and any other remedy which could have otherwise be available in law is hereby excluded except to the extent that such exclusions is prohibited by any rule of law. The company reserves the right to use remanufactured or refurbished parts during repairs. This warranty does not apply to and no responsibility is accepted for goods which have suffered or been subjected to undue wear and tear accident mis-use improper application, modification, neglect or overloading and in no circumstances shall the Company be liable for loss or damage of any kind indirectly or directly caused by or arising from goods supplied or for any accident or injury to personnel or damage to property howsoever arising from or in the course of using such goods.

12 Month warranty on all batteries.
3 Month warranty on repairs.

PICTURES / DRAWINGS
All pictures and drawings are intended for descriptive purposes only, and are intended to assist with the identification of the type of product being viewed and information only and in no circumstances shall the Company be liable for loss or damage of any kind indirectly or directly caused by or arising from information supplied or for any accident or injury to personnel or damage to property howsoever arising from or in the course of using such information. Some pictures may include other products from the product range, this does not imply that they are part of the package or item being sold, any quantities in pictures are for display purposes only, only quantities identified in the shopping trolley will be dispatched. Versions of items may also change over time. Every care has been taken to ensure continuity and accuracy of drawings and descriptions, however it is the buyers responsibility to ensure that the suitability of goods purchased match the use they are intended.

PRIVACY POLICY
We are committed to protecting your privacy. The company is committed to follow and obeying all relevant government guidelines and Acts. Information will only be used by the company and associated companies.

The Company accepts no responsibility and is not to be liable for the cost of work or other charges expended or put upon goods supplied by them and subsequently found to be defective. Any error omission or misrepresentation or mis-statement in the agreement or in the course of negotiation leading thereto shall not entitle either party to rescind the Agreement nor (unless the error or omission misrepresentation or mis-statement relates to a matter materially affecting the value of the goods and the Agreement has been entered into on reliance thereon) shall either party be entitled to any damages or compensation in respect thereof. The Companies rights and remedies shall not be prejudiced by any indulgence or forbearance to the Buyer and no waiver by the company of any breach by the buyer shall operate as a waiver of any subsequent breach. In the event that these terms and conditions shall become or shall be declared by any court of competent jurisdiction to be invalid or unenforceable in any way such invalidity or un-enforceability shall no way impair or affect any of the other conditions hereof all of which remain in full effect.

APPLICABLE LAW
This contract shall in all respects be governed by and construed in accordance with the English law the buyer hereby submits to the non-exclusive jurisdiction of the English courts.
